  1. WHO IS RUNNING THE COMPETITION?

The competition is The Food Porn Awards™, operated by Shoot the Moon Design Consultants Ltd (“Shoot the Moon”). The registered address is c/o SCCA Ltd, 3 The Studios, 320 Chorley Old Road, Bolton, BL1 4JU.

  1. THE COMPETITION
    • The title of the competition is The Food Porn Awards™.
    • The Food Porn Awards™ are open to chefs, cooks, caterers, restaurant managers and owners across the north of England. Photographs uploaded of your dish will be put forward for judging by Shoot the Moon’s judging panel.
    • The competition has four categories:
      • Fine Dining;
      • Casual Dining;
      • Street Eats; and
      • Sweet Treats
  2. HOW TO ENTER
    • The competition will run from 09:00 on 27th August 2018 to 23:59 on 27th September
    • All competition entries must be received by Shoot the Moon by no later than 23:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
    • To enter the competition, you need to submit a photograph to Shoot the Moon through the submissions form on the website by the Closing Date.
    • No purchase is necessary to enter the competition.
    • All shortlisted entrants must be willing and available to attend the cook-off stage at STM Photography studios in Manchester for a day (to be agreed) between 22nd October 2018 and 16th November 2018.
    • Shoot the Moon will not accept:
      • responsibility for competition entries that are lost, mislaid or damaged, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
      • proof of transmission as proof of receipt of entry to the competition.
    • By submitting a competition entry, you are agreeing to be bound by these terms and conditions.
    • You must not upload or submit to Shoot the Moon, anything which in any respect;
      • is in breach of any law, statute, regulation or byelaw of any applicable jurisdiction;
      • is fraudulent, criminal or unlawful;
      • is inaccurate or out-of-date;
      • is obscene, pornographic, indecent, vulgar, discriminatory, offensive, threatening, defamatory or untrue;
      • is in contravention of any applicable law, nor allow or assist any third party in doing so;
      • impersonates any other person or body or misrepresents a relationship with any person or body;
      • may infringe or breach the copyright or any other intellectual property rights of any third party;
      • may be contrary to Shoot the Moon’s interests;
      • is contrary to any specific rule or requirement that Shoot the Moon may stipulate for the competition; or
      • involves your use, delivery or transmission of any viruses, unsolicited communications, Trojan horses, trap doors, cancelbots, backdoors, worms, Easter eggs, time bombs or computer programming routines that are intended to damage, interfere with, surreptitiously intercept or expropriate any data, personal information or system.

    • The competition entries will be judged by a panel of judges and based on the overall look of the dish. The decision of the panel of judges will be final.
  3. ELIGIBILITY
    • The competition is open to all professional chefs, professional cooks, professional caterers, restaurant managers and/or restaurant owners located in the north of England, except:
      • employees of Shoot the Moon or its holding or subsidiary companies;
      • employees of agents or suppliers of Shoot the Moon or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
      • members of the immediate families or households of 1.1 and 4.1.2 above.
    • For the avoidance of doubt, the following counties are considered as being in the north of England for the purposes of these terms and conditions:
      • Cheshire;
      • Cumbria;
      • County Durham;
      • East Riding of Yorkshire;
      • Greater Manchester;
      • Lancashire;
      • Merseyside;
      • Northumberland;
      • North Yorkshire;
      • South Yorkshire;
      • Tyne and Wear;
      • West Yorkshire;
      • North Lincolnshire; and
      • North East Lincolnshire
    • In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. Shoot the Moon may require you to provide proof that you are eligible to enter the competition.
    • Shoot the Moon will not accept competition entries that are:
      • a photograph taken by a professional photographer or marketing company;
      • automatically generated by computer;
      • completed by third parties or in bulk;
      • illegible, have been altered, reconstructed, forged or tampered with;
      • photocopies and not originals; or
    • There is no limit on the number of entries that may be submitted per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
    • Shoot the Moon reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.
  4. THE PRIZE
    • The prize is a Food Porn Awards trophy and 5 are available to be won.
    • The Prize is subject to availability. Shoot the Moon reserves the right to substitute the prize with a prize of equal or greater value.
    • The prize is not negotiable nor can it be transferred to a third party.
  5. WINNER ANNOUNCEMENT
    • The winner of the competition will be announced at the Food Porn Awards™ ceremony which is to take place on 7th February 2019.
    • The decision of the judges nominated by Shoot the Moon is final and no correspondence or discussion will be entered into.
  6. LIMITATION OF LIABILITY

Insofar as is permitted by law, Shoot the Moon, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Shoot the Moon, its agents or distributors or that of their employees. Your statutory rights are not affected.

  1. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
    • All competition entries and any accompanying material submitted to Shoot the Moon will become the property of Shoot the Moon on receipt and will not be returned.
    • By submitting your competition entry and any accompanying material, you agree to:
      • assign to Shoot the Moon all your intellectual property rights with full title guarantee; and
      • waive all moral rights in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.]
  1. DATA PROTECTION

Shoot the Moon will only process your personal information as set out in Shoot the Moon’s privacy policy.

  1. GENERAL
    • If there is any reason to believe that there has been a breach of these terms and conditions Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition
    • Shoot the Moon reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
    • These terms and conditions are governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
